    TENNIS COURTS PARCEL X – aka PP-91

    The two tennis courts and playground area are nestled amidst Meadow Spring on the left (north), Silver Meadows on top (east), Ptarmigan on the right (south), and Quail Meadows Townhomes on the bottom (west).


    1980 – April 20 –  Meadow Wild (Meadow Spring, Silver Meadows, Silver Springs Townhouses) Phase 1 – HOA Documents.

    1981 – September 8 – Summit County Planning Commission Meeting Minutes. “Jim Webster – Silver Springs recreational facility – tennis court & swimming pool, …as well as 1-D (South Shore) exact location of the lake and buffer strip. The cul-de-sac [Park Place] may still be eliminated.”

    1982 – Sept. 27 – East Tennis Court, Quit Claim Deed from SSD to DLB, Inc. (Don Stringham), Entry 290095.

    1989 – June 2 – Letter from Barnes regarding tennis courts and Don Stringham.

    1989  – The Dev-HOA Agreement states: “2. Conveyance of Tennis Court Parcel. Developer shall execute a Special Warranty Deed conveying that certain common area parcel, hereinafter described and known as the “Tennis Court Parcel” to each of the homeowner associations named herein, as grantees. The terms and conditions of escrow, including commencement thereof and eventual delivery of deed, shall be identical to the provisions set forth in paragraph 1 concerning conveyance of the Park Parcel.

    “The Tennis Court Parcel is an area of approximately 0.67 acre (PP-91) and includes one [was owned by Willowbend West until 1989], of two tennis courts installed thereon, along with a small open area immediately adjacent thereon. The other tennis court [owned by Meadow Spring/Meadow Wild] at the site is not owned by the Developer, who is under no obligation to acquire the same for the benefit of the Homeowners; however, if acquired by Developer, the other tennis court will be conveyed to the Homeowners. The Tennis Court Parcel is located in the southeastern portion of the Subdivision,….”—1989 Dev-HOA Agreement

    Parcel PP-91 had a 1982 deed from SSD, Inc.  This was conveyed in 1987-88 to DLB, Inc.  This was then conveyed back in 1988 to SSS or SSD, Inc, who then conveyed it in 1989 to Silver Springs Associates.  In 1990 it was conveyed to the MA.  The language of the Dev.-Homeowner Agreement lays doubt about whether the MA owns the entire parcel and both tennis courts and parking area (future 3rd court) or whether a portion is owned by an unknown second party.

    A Special Warranty Deed dated August 14, 1989 from DLB (Don Stringham) to Mike Barnes of Silver Springs Associates conveys the east tennis court to SSA with Entry 311694.

    According to the Summit County Recorder’s Office the Dev-Homeowner Agreement is incorrect in stating that the MA does not own the entire Parcel PP-91.  The County Recorder states that the survey dimensions of the Parcel include  the two tennis courts and the area east along the road for a future court.  Meadow Wild Phase 1 (Meadow Spring) owns the 65′ x 132′ on the northwest portion.  The 1989 Dev-Homeowner Agreement needs to be amended to indicate the north west tennis court is within the Meadow Wild Phase 1 (Meadow Spring) subdivision’s recorded parameters.

    1994 – The MA spent $4625. for Tennis park equipment, and $6,479.30 for Tennis parcel landscaping.

    2001 – The MA spent $6,474 for both Tennis Courts repairs. Meadow Wild/Meadow Springs did not contribute extra for the north court that they hold title to.

    2005 – April 18, Rick Hovey received a rough bid from Warren Pretorius for $80,000 to replace the MA court and the Meadow Spring/Meadow Wild court. Will MW/MS contribute toward their share of the repair or replacement?

    2007  – The MA engaged in the renovation of both Tennis Courts on Parcel PP-91.  $76,477.50 was spent to tear out the cement and ground under the courts, then replaced with a better surface, and other improvements. The MA holds title to only one ot these courts.  The other court continues to be privately held by Meadow Spring/Meadow Wild subdivision(s)..

    2010  – March – Larry Eichner, former Willowbend West HOA board president proposed c.1989 to transfer the responsibility for the tennis courts.  Larry remembers that Willowbend West held outright title to the Tennis Courts.  The WBW board and members saw the courts as an albatross and wanted to be rid of the expense of maintenance and liability insurance so Larry made an arrangement, “Plan L” with Mike Barnes (the SSD developer) for the Tennis Courts to be part of the 1990 Developer-Homeowner Agreement to transfer a Special Warranty Deed to the Master HOA.  [A Special Warranty Deed gave Barnes’s promise to transfer the property to the MA limited to his period of ownership.  A deed of title to real property by which the grantor warrants that he is not personally responsible for any title defects, but making no warranties or representations as to the quality of the title in other respects.]

    Following the title history, Meadow Wild Condo subdivision included the property on which Meadow Spring Single Family homes were built.  Both subdivisions seem to share Bylaws and CCRs but have two different HOA boards.  The section map above states the 65′ X 132′ section of the tennis court parcel belongs to Meadow Wild Phase 1 which is to say Meadow Spring.
